Iroquois Falls Legislation - Cats

  THE CORPORATION OF THE TOWN OF IROQUOIS FALLS
BY-LAW NO. 2764/99



"Being a By-Law to provide for the licensing, registration and regulation of cats in the Corporation of the Town of Iroquois Falls."

WHEREAS The Municipal Act, R.S.O. 1990 C.M 45 authorizes a municipality to pass by-laws prohibiting, regulating, restricting and requiring the licensing of animals, and further authorizes a municipality to pass by-laws prohibiting and abating public nuisances;

WHEREAS The Pounds Act R.S.O. 1990 C.17 authorizes a municipality to impound animals found to be running at large;

WHEREAS The Environmental Protection Act R.S.O. C.E 19 authorizes a municipality to pass by-laws restricting or prohibiting noise;

AND WHEREAS it is considered desirable to pass a by-law to provide for the licensing, regulation and registration of cats within the corporate boundaries of the Town of Iroquois Falls.

NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF IROQUOIS FALLS ENACTS AS FOLLOWS:

1.  SHORT FORM TITLE: THIS BY-LAW BE REFERRED TO AS THE "CAT BY-LAW".

2.  DEFINITIONS:

  1. ANIMAL CONTROL OFFICER: shall mean the person or persons appointed by the Council of the Corporation of the Town of Iroquois Falls.
  2. ANIMAL: shall mean any member of the animal kingdom of living beings, excluding humans, without limitation, animal shall include mammals, dogs, cats, birds and reptiles.
  3. ANIMAL SOUNDS: shall mean any sound emitted from an animal, dog or cat, which is audible at premises occupied by persons other than the owner of the animal emitting the sound, without limitation this term shall include barking, whimpering, whining, howling and yelping.
  4. CAT: shall mean a domesticated carnivore of the species felis familiaris, whether male, female, spayed or neutered, that has been weaned.
  5. HOUSEHOLD: shall mean any house, mobile home, dwelling unit or apartment unit occupied as a single housekeeping unit for residential purposes and includes any outdoor space or accessory buildings associated with the household.
  6. MUNICIPAL PROPERTY: shall mean all property owned, leased or under control of the Town and shall include all parks, open space, opened or unopened road allowances, sidewalks, footpaths and bicycle trails.
  7. OWNER: shall mean any person who possesses, keeps or harbours animals.
  8. PERSON: shall mean an individual, a sole proprietorship, a partnership, an unincorporated association, a trust, a body corporate and a natural person.
  9. RUNNING AT LARGE: shall mean any animal found in any place other than the owners property.
  10. TOWN: shall mean the corporate boundaries of the Town of Iroquois Falls.

 

3.  OFFENCES:

  1. NUMBER OF CATS It shall constitute an offence for a person to own more than three (3) cats within any household.
  2. EXCREMENT ON PROPERTY OTHER THAN THE ANIMAL OWNER'S It shall constitute an offence for the owner of an animal to fail to immediately remove excrement deposited by the animal upon property, other than the owner's property.
  3. FAILURE TO REGISTER It shall constitute an offence for any person who owns a cat not to register and obtain a cat tag for each cat he or she owns as per fee set out in Schedule "A" of this By-Law.
  4. RUNNING AT LARGE It shall constitute an offence for the owner of a cat to cause, permit or allow the cat or cats to run at large.

 

4.  EXEMPTION TO SECTION 3

The provision of Section 3(a) shall not apply to volunteers who own animals from time to time pursuant to their work with an adoption agency which has been approved by the Town. This exemption applies only for animals which have been registered and are at the foster home for a period of time no longer than eight (8) months. Exempt also are the Animal Hospital and/or licenced pet shops.

5. IMPOUNDED CATS

Where a cat is impounded without a tag, the owner shall in addition to any fee or penalty imposed, register and obtain a tag from the town prior to the cat being released.

6. IMPOUND FEE

Any cat impounded for running at large shall be impounded for a period of seventy-two hours (72) exclusive of statutory holidays, Saturdays and Sundays after the date of seizure and the owner will pay to the Treasurer of the Town, a Pound Fee of fifteen dollars ($15.00) plus a fine of fifty-three dollars ($53.00) plus costs if paid out of court, plus a maintenance fee of five dollars ($5.00) for each day subsequent to the day of seizure that the cat remains impounded.

7. INJURED CAT

Upon impoundment where a cat is suffering illness or injury, and it is in the opinion of the Animal Control Officer that the cat will not humanely sustain life, it shall be humanely destroyed.

8. EUTHANASIA OF CAT

Where a cat has been impounded under Section 5 of this By-Law, and has not been claimed after seventy-two hours (72) have elapsed excluding the day of impoundment, the animal may be sold or released at no charge to a non-profit agency which provides the service of co-ordinating animal adoptions, or have the cat humanely destroyed.

Where a cat(s) have been turned over to such an adoption agency, the cat(s) shall not be released to any resident in the Town without first being registered under the provisions of this By-Law.

9. PENALTIES

  1. Any person who contravenes any provision of this By-Law is upon conviction liable to a fine not exceeding five thousand dollars ($5,000.00) exclusive of costs for each offence, and every such fine is recoverable under The Provincial Offences Act.
  2. Each day a violation continues shall be deemed to be a separate offence.

10. This By-Law shall come into effect 30 days after the date of final passing thereof.
